    EVOLTZ APPLICATION PRIVACY POLICY

    Privacy Policy for PT Electric Vehicle Solusi Nusantara or Evoltz Application

    This Privacy Policy represents Evoltz's commitment to respect and protect every data or personal information of Evoltz Application Users, including the Evoltz mobile application (hereinafter referred to as "Application or Evoltz").

    This Privacy Policy (along with the terms of use of the Evoltz Application as stated in the Terms & Conditions and other information listed in the Application) sets the basis for the acquisition, collection, processing, analysis, display, delivery, disclosure, storage, modification, deletion, and/or any form of management related to data or information that identifies or can be used to identify Users that Users provide to Evoltz or that Evoltz collects from Users and third parties (hereinafter referred to as "Personal Data").

    By downloading and installing the Evoltz application or agreeing to the use of the Evoltz Application, the User declares that all Personal Data provided is true and valid, acknowledges that they have been informed and understand the provisions of this Privacy Policy, and gives consent to Evoltz to obtain, collect, process, analyze, display, send, disclose, store, modify, delete, manage, and/or use the data for purposes outlined in this Privacy Policy.

    A. Acquisition and Collection of User Personal Data

    Evoltz collects User Personal Data to process User transactions, manage and facilitate the use of the Application, and for other purposes permitted by applicable laws and regulations. The data collected from Users includes:

    1. Data provided by Users, including but not limited to data submitted when Users:

    • Create or update an Evoltz account, including username, email address, phone number, password, address, photo, and other identifying information;
    • Contact Evoltz, including through customer service;
    • Fill out surveys sent by Evoltz or officially appointed representatives;
    • Interact with other Users using review, rating, Resolution Center, and other interactive features within the Application;
    • Use services within the Application, including detailed transaction data such as type, amount, product/service description, delivery address, payment channels used, transaction amount, transaction date and time, and other transaction details;
    • Fill in payment data during transaction activities through the Application, including bank account data, credit card, virtual account, instant payment, internet banking, retail outlets; and/or
    • Use features in the Application that require access to relevant data stored on the User's device.

    2. Data recorded when Users use the Application, including but not limited to:

    • Real or estimated location data such as IP address, and geo-location;
    • Time data of each User activity related to the use of the Application, including login and transaction times;
    • User usage or preference data, including User interactions within the Application, saved choices, and selected settings. This data is obtained using cookies, pixel tags, and similar technologies that create and maintain unique identifiers;

    3. Data obtained from other sources, including but not limited to:

    • Geolocation data (GPS), including from payment service partners, logistics or couriers, Application infrastructure, and other partners;
    • Email data, phone numbers, names, genders, and/or birth dates from Evoltz business partners where Users create or access Evoltz accounts, such as social media services, or Applications that use Evoltz application programming interfaces (APIs) or used by Evoltz;
    B. Use of Personal Data

    Evoltz may use the Personal Data obtained and collected from Users as mentioned above for the following purposes:

    • Processing any requests, activities, or transactions conducted by Users through the Application, including product delivery to Users.
    • Monitoring or investigating suspicious transactions or those indicating fraud or violations of the Terms and Conditions or applicable laws, and taking necessary actions as a follow-up to monitoring or investigating these transactions.
    • In certain circumstances, Evoltz may need to use or disclose User Personal Data for law enforcement purposes or to comply with legal and regulatory requirements, including in the event of a dispute or legal process between Users and Evoltz, or suspected criminal acts such as fraud or data theft.
    C. Disclosure of User Personal Data

    1. Evoltz is committed to maintaining the confidentiality of User Personal Data under Evoltz's control and guarantees no disclosure, sale, transfer, distribution, and/or lending of User Personal Data to third parties without User consent, except in the following cases:

    • When disclosure of User Personal Data is necessary to partners or third parties who assist Evoltz in providing services available or in the future available on the Application and processing any User activities in the Application, including processing transactions, verifying payments, promotions, and product deliveries.
    • Evoltz may provide User Personal Data to third parties using and integrating the public API provided by Evoltz (including but not limited to Evoltz business service providers) with applications operated for transaction resolution purposes between Buyers and Sellers on the Application or other purposes of using Personal Data mentioned in section B of this Privacy Policy.
    • When communication between Evoltz business partners (such as logistics providers, payment, and service feature providers) and Users is necessary to resolve issues or other matters.
    • Evoltz may provide User Personal Data to vendors, consultants, marketing partners, research firms, or similar service providers in the context of third-party marketing activities, improving and maintaining the quality of Evoltz services, and other publicity activities.
    • Evoltz may share User Personal Data with subsidiaries and affiliates to help provide services or process data on behalf of Evoltz.
    • Evoltz discloses User Personal Data in compliance with legal obligations and/or legitimate requests from law enforcement or authorized state institutions.

    2. Regarding the disclosure of User Personal Data as described above, Evoltz may need to disclose User Personal Data to third-party service providers, agents, and/or Evoltz affiliates, and/or other third parties located outside Indonesia. However, these third-party service providers, agents, and/or affiliates, or other third parties will only manage and/or utilize User Personal Data concerning one or more purposes outlined in this Privacy Policy and according to applicable laws and regulations.

    D. Cookies

    Cookies are small files that automatically take a place on the User's device that performs functions in storing User preferences or configurations during visits to an Application.

    These cookies are not intended to access other data owned by the User on their computer device except those that the User has agreed to share.

    While the User's computer device automatically accepts cookies, the User can choose to modify their browser settings to reject cookies (this option may hinder the optimal availability of Evoltz services when Users access the Application).

    E. User Choices and Transparency

    Generally, mobile devices (iOS and Android) have settings so that the Evoltz application cannot access certain data without User consent. iOS devices will notify Users when the Evoltz application first requests access to such data, while Android devices will notify Users when the Evoltz application is first loaded. By using the application and giving access to the application, Users are considered to have given their consent to the collection and use of User Personal Data on their devices.

    Users can access and change information such as email addresses, phone numbers, birth dates, genders, address lists, payment methods, and bank accounts through the Employee Data Changes feature on the Application.

    Evoltz may send messages or emails containing transaction information or account-related information to Users.

    As long as it does not conflict with applicable laws and regulations, Users can contact Evoltz to withdraw their consent regarding the acquisition, collection, storage, management, and use of their data. In such cases, Users understand the consequences that they cannot use the Application services or other Evoltz services.

    F. Security, Storage, and Deletion of User Personal Data

    Evoltz protects every User Personal Data stored in its system and protects this data from unauthorized access, use, modification, retrieval, and/or disclosure using various security measures and procedures, including User passwords and emails.

    User Personal Data may also be stored or processed outside the country by parties working for Evoltz in other countries, or by third-party service providers, vendors, suppliers, partners, contractors, or Evoltz affiliates. In such cases, Evoltz will ensure that Personal Data remains protected according to Evoltz's commitments in this Privacy Policy.

    Although Evoltz has made its best efforts to secure and protect User Personal Data, it is important to note that data transmission over the Internet is never completely secure. Therefore, Evoltz cannot guarantee 100% security of data provided or transmitted to Evoltz by Users, and providing information by Users is at their own risk.

    Evoltz will delete and/or anonymize User Personal Data under Evoltz's control when (i) the Personal Data is no longer necessary to fulfill the purpose of its collection; and (ii) storage is no longer necessary for compliance with applicable laws and regulations.

    Please note that some User Personal Data may still be stored by other parties, including authorized state institutions. If we share User Personal Data with authorized state institutions or other institutions appointed by the competent government or have cooperation with Evoltz, Users agree and acknowledge that the storage of User Personal Data by these institutions will follow the data storage policies of each of these institutions.

    G. Access and Correction of User Personal Data or Withdrawal of Consent

    Evoltz takes reasonable steps to ensure that User Personal Data is processed accurately and completely. However, it is important for Users to notify Evoltz in a timely manner about any changes to User Personal Data or if there are any errors in User Personal Data under Evoltz's control.

    Users have the right to access or correct User Personal Data under Evoltz's control through Evoltz's customer service available in this Privacy Policy. However, such requests will only be processed by Evoltz if Users have provided adequate proof of identity to access or correct the data. Evoltz reserves the right to refuse requests to access, or to correct, some or all User Personal Data that Evoltz holds or controls if permitted or required under applicable laws. This includes situations where such Personal Data may contain references to others or where the request for access or request for correction is for reasons that Evoltz considers irrelevant, not serious, or troublesome.

    Users can withdraw the consent they have provided regarding the processing of User Personal Data under Evoltz's control by submitting such a request through Evoltz's customer service listed in this Privacy Policy. Evoltz will process Users' requests within a reasonable time after the withdrawal of consent is submitted, and subsequently will not process Users' Personal Data following Users' initial requests, except as required by applicable laws. In case of withdrawal of consent, Evoltz may not be able to fulfill its obligations under any agreement between Users and Evoltz. In this regard, it is also possible that because Evoltz cannot fulfill its obligations due to Users withdrawing their consent, any legal relationship between Users and Evoltz may terminate and cannot be continued.

    H. Complaints Related to User Data Protection

    If Users have concerns about Evoltz's handling or treatment of User Personal Data or if Users believe their privacy has been violated, Users can contact Evoltz through Evoltz's customer service or contact listed in this Privacy Policy by explaining the User's identity and the nature of the complaint.

    Evoltz will investigate Users' complaints and strive to respond to such complaints within a reasonable time after receiving the complaints submitted by Users.

    J. Storage and Deletion of Information

    Evoltz will retain information as long as the User's account remains active and can perform deletions in accordance with applicable legal provisions.

    K. Privacy Policy Updates

    Evoltz may make changes or updates to this Privacy Policy from time to time. Evoltz advises Users to read and review this Privacy Policy page periodically to be aware of any changes. By continuing to access and use the Application services or other Evoltz services, Users are deemed to agree to the changes in this Privacy Policy.
